Three Types of Protection Orders
Protection From Abuse: PFA
Eligibility
- Victim must be 18 years or older OR have an adult guardian file on their behalf AND
- The abuser MUST be one of the following: Related to the victim by blood or marriage (i.e., parent, child, stepparent, a household relative) A current or former spouse a current or former intimate partner, including same sex partners(i.e. boyfriend/girlfriend or father/mother of your children)
File in the county where:
- The victim lives or works
- The abuser lives
- An abusive incident occurred
If the victim fled their home to avoid further abuse, they may have the right to file in another county.
Under PA law, PFAs include protection from:
- Physical Assault
- Sexual Assault
- Harassment
- Stalking
- Threats or causing fear of bodily injury
- False imprisonment
NOT included under PA Law:
- Mental or emotional abuse
- Arguments concerning custody of children
Protection may include conditions such as:
- No contact with victim(s)
- Drug and alcohol evaluation/treatment
- Mental health evaluation/treatment
- Attend the NOVIS program
- Special custody provisions
- Firearms ordered to be confiscated
Sexual Violence Protection: SVP
Eligibility
- The abuser MUST NOT be a household, family member, or intimate partner relationship with the victim Under PA law, SVPs include protection from:
- Sexual offenses
- Sexual abuse and exploitation of children
- Unlawful contact with a minor
- Endangering the welfare of children
- Protection may include conditions such as:
- No contact with victim(s)
- Drug and alcohol evaluation/treatment
- Mental Health evaluation/treatment
- Firearms be confiscated
- Any other appropriate relief
Protection From Intimidation: PFI
Eligibility
- The abuser MUST NOT have a household, family member, or intimate partner relationship with the victim
- The abuser MUST be OVER 18 years of age
- The victim MUST be UNDER 18 years of age
Under PA law, PFIs include protection from:
- Harassment
- Stalking
Protection may include conditions such as:
- No contact with victim(s)
- Drug and alcohol evaluation/treatment
- Mental Health evaluation/treatment
- Firearms be confiscated
- Any other appropriate relief
